HOA Pool Rules

These pool rules bind both homeowners and guests. Infractions by guests will be the responsibility of the homeowner responsible for the guest.

  • An Adult Homeowner of the Association must accompany all Guests and Children using the pool.

  • Hours of Operation: 4:30 a.m. through 11:00 p.m. Exceptions for maintenance, health and safety conditions, inclement weather or other reasons may be made at the discretion of the Management Committee.

  • The pool is not available for private parties.

  • All accidents, safety and security issues, and maintenance concerns are to be reported to the Management Committee or the Management Company.

  • Amplified sound equipment is not permitted.  Use of equipment with earphones will be permitted.

  • All alcohol and tobacco products are prohibited (including snuff and cigarettes, pipes, vaping and cigars). Persons under the influence of alcohol or other intoxicants will be denied access to the facilities.

  • Be courteous and pick up after yourself.  This is your facility.  Please treat it with the care and respect you have for your own property.

State Pool Rules

  • Any child under three years old, any child not toilet trained, and anyone who lacks control of defecation shall wear a water-resistant swim diaper and waterproof swimwear. Swim diapers and waterproof swimwear shall have waist and leg openings fitted such that they are in contact with the waist or leg around the entire circumference.

  • A person who has or has had diarrhea within the last two weeks caused by an unknown source or from any communicable or fecal-borne disease may not enter any public pool.

  • Children under the age of five years are prohibited from bathing in a spa or hot tub.

  • Food or drink is prohibited within ten feet of the pool. Beverages must be served in non-breakable containers.

  • A bather using the facility must take a cleansing shower before entering the pool enclosure. A bather leaving the pool to use the toilet must take a second cleansing shower before returning to the pool enclosure

  • Running, boisterous play, or rough play, except supervised water sports, are prohibited.

  • Visitors, spectators, or animals may not be allowed within 10 feet of the pool. Registered service animals are exempt from this requirement.

  • WARNING - NO LIFEGUARD ON DUTY, bathers should not swim alone, children 14 and under shall not use pool without responsible adult supervision.

  • Lifesaving equipment must not be used for any reason other than its intended purpose.

  • Individuals under the influence of alcohol or other impairing chemical substances should not use the spa pool.

  • Use of the pool facility during off hours is not permitted.

Liability

All Owners and Guests using the swimming pool incur a certain risk.  The Association, the Management Committee (Board) and the Management Company shall not be liable for any accident, loss or injury in connection with such use except as may be determined in a court of law.

The Association, the Management Committee and the Management Company may dismiss persons in violation of these rules, exhibiting offensive behavior, or failure to provide proper identification permitting use of the facility.  Use of the pool is a privilege and the requests of the Association, Board and Management Company must be honored at all times.  Pool privileges may be temporarily suspended in cases of violation of these rules. Any damage or cleaning fees caused by a Homeowner or Guest is the responsibility of the Homeowner.

Enforcement

Homeowners are responsible for enforcing these pool rules and reporting infractions to the Management Company. The board will assist with serious issues as needed and available, but it is the responsibility of home owners to enforce these rules when they are at the pool.  

The board will impose the following consequences for infractions:

  • 1st infraction—clubhouse privileges (one day suspension)

  • 2nd infraction—clubhouse privileges (one week suspension)

  • 3rd infraction—clubhouse privileges (one month suspension)

  • 4th infraction—clubhouse privileges (season suspension)

  • 5th infraction—clubhouse privileges (permanent suspension)

  • Police-involved infraction—clubhouse privileges (season or permanent suspension)

  • Damages—fine for cleaning or replacement of property in the amount of damage

  • Note: No HOA dues are refunded when a homeowner is barred from using the clubhouse or pool.

 Poop Incidents 💩

  • The homeowner responsible for the person or child that defecates in the pool will be assessed a fine equal to the cost of cleaning and chemical treatment.

  • The fee may be waived by the Management Committee if appropriate swim diaper & pants are worn and the HOA is notified of the accident in a timely manner.
